01Acceptance and parties
These terms (the "Terms") are between Thurlow Marketing Group ("Thurlow"), Toronto, Ontario, and the person or business that accepts them at checkout (the "Client"). They apply to Sprints accepted on or after October 16, 2026. Version: 2026-10-16.
The Client accepts these Terms by ticking the acceptance box at checkout and paying. Thurlow keeps a record of the acceptance, including the date, time and email address used.
The person accepting confirms they have authority to bind the Client. The Client's legal name, signatory, address, priority offer, priority buyer and case study choice are confirmed in the Sprint intake form. Those answers form part of these Terms.
02Purpose
Thurlow will run the Obvious Choice Sprint for the Client (the "Sprint"): a 30-day engagement that diagnoses the primary buyer barrier (Find, Recognize, Trust or Choose) holding back buyers who were not referred to the Client, then builds and launches one priority asset or change aimed at that barrier.
The priority offer and priority buyer are the ones the Client confirms in the intake form. Touchpoint 1 is booked by the Client after payment. Launch is scheduled by Day 30.
03Deliverables
Thurlow will deliver the following.
- The Blueprint. A written document containing:
- the primary buyer barrier, the evidence behind it and the alternative explanation tested;
- the priority buyer and the language that buyer uses;
- the priority build, with its brief and the measure for judging whether it worked;
- a high-level 90-day rollout plan.
- One priority build. One asset or change aimed at the primary buyer barrier, chosen in the Blueprint. Thurlow drafts it, revises it with the Client in two rounds of revisions, and launches it.
- A Follow-up Playbook. A short written sequence the Client's team can run without Thurlow.
- Touchpoints. Touchpoint 1 (Founder Diagnostic, 60 minutes), Touchpoint 2 (Blueprint Walkthrough), a Build Check around Day 21, and a Pre-launch Check before launch. Thurlow also reviews the launch with the Client in Week 4.
- The Obvious Choice Lab (bonus). 12 months of access to the Obvious Choice Lab, starting when payment is confirmed, at no extra charge. If the Sprint ends before Day 1 under clause 1, 2, 5 or 6 of section 7, access ends when the refund is paid. If the Sprint ends on or after Day 1, or because of Thurlow, the Client keeps the full 12 months.
The Blueprint separates what is observed in the evidence, what the Client reports, what is Thurlow's hypothesis, and what is unknown.
04Timeline
The Sprint runs for 30 consecutive calendar days, counting Day 1 as the first day. "Day 1" is the day of Touchpoint 1, once Thurlow has confirmed in writing that the Client's evidence is sufficient to begin. If that confirmation comes after Touchpoint 1, Day 1 is the day Thurlow gives it. A "business day" is Monday to Friday, excluding statutory holidays in Ontario, and business days are counted starting the day after Day 1. The Opening phase runs from Day 1 until the Blueprint is delivered, which can be as late as calendar Day 8. All times are Toronto time.
| When | What happens |
|---|---|
| Before Day 1 | The Client accepts these Terms and pays, books Touchpoint 1, and submits the intake form 2 business days before it. |
| Opening phase | Touchpoint 1. Thurlow delivers the Blueprint within 5 business days after Day 1. Touchpoint 2 follows. |
| Weeks 2 and 3 | Thurlow builds the priority build. The Client reviews each draft. Build Check around Day 21. |
| Week 4 | Pre-launch Check, launch, and launch review. Thurlow delivers the Follow-up Playbook. |
If the Client misses an evidence or approval deadline in section 5, the affected dates move by the same number of days, and the late-Blueprint remedy in section 7 pauses for that period.
05Client responsibilities
The Client will:
- Complete the intake form, including the confirmation questions, 2 business days before Touchpoint 1.
- Provide buyer evidence: sales call recordings or notes, reviews, customer emails and lost-deal notes.
- Have the person who decides on marketing attend every touchpoint.
- Approve each draft, or send comments on it, within 2 business days.
- Give Thurlow named-user access to any account it needs to see, in place of shared passwords.
- Publish the build on the agreed launch date, or arrange for someone to do so.
- Make sure the information and materials it provides are accurate, and that it has the right to share them. The Client is responsible for the claims it chooses to publish.
06Fee and payment
The fee for the Sprint is US$2,250, paid in one payment at checkout before Day 1. All amounts in these Terms are in US dollars. Thurlow does not charge HST on this fee.
The fee does not include advertising spend, software subscriptions, licensed images or fonts, or other third-party costs. The Client pays those costs to the providers.
07Cancellation, refunds and guarantees
Thurlow will pay any refund under this section to the original payment method within 10 business days of the Client's written notice or Thurlow's determination.
- Before Touchpoint 1. The Client can cancel for any reason by written notice given at least 24 hours before Touchpoint 1 and receives a full refund.
- Insufficient evidence. If Thurlow determines before Day 1 that the evidence is not sufficient to begin, it will say what is missing. If the Client does not supply it, the Client receives a full refund.
- Late Blueprint. If Thurlow does not deliver the Blueprint within 5 business days after Day 1, the Client chooses, by written notice, between (a) a full refund, ending the Sprint, with the Client keeping the Blueprint, or (b) finishing the Sprint and receiving US$1,125 back.
- Leaving after the Walkthrough. Within 2 business days after Touchpoint 2, the Client can end the Sprint by written notice and receives US$1,125 back. Thurlow keeps the Blueprint work, and the Client keeps the Blueprint.
- Missed Touchpoint 1. Touchpoint 1 is missed if the Client has not joined within 15 minutes of the start, or cancels it with less than 24 hours' notice. Thurlow then offers one replacement time within 5 business days. If the Client does not book it within 5 business days of Thurlow's offer, or misses the replacement or cancels it late, Thurlow may end the Sprint by written notice. If the Sprint ends this way, or the Client chooses to end it after a missed Touchpoint 1, Thurlow keeps US$500 and refunds US$1,750. Clause 1 no longer applies once Touchpoint 1 has been missed. A call missed because of Thurlow, such as its own cancellation or a broken meeting link, does not count against the Client.
- Touchpoint 1 not booked. If the Client has not booked Touchpoint 1 within 10 business days after payment, Thurlow will remind the Client in writing. If it is still not booked 5 business days after that reminder, Thurlow may end the Sprint by written notice, keep US$500 and refund US$1,750, unless the Client has already cancelled under clause 1.
- No other conditions. No other conditions apply to a refund under this section. These refunds are the Client's remedy for the events they cover, to the extent the law allows.
08What is not included, and changes
The Sprint does not include:
- more than one priority build, or more than two rounds of revisions to it;
- ongoing management of the Client's marketing, content or advertising after Week 4;
- setting up the Client's software tools;
- advertising spend or third-party costs.
If the Client asks for work outside these Terms, Thurlow will give a written quote for it. It is added only by a written change agreed by both parties, and it does not change the fee, the dates or the refunds above unless the change says so.
09No promise of results
Thurlow does not promise leads, sales conversations, clients or revenue. Those depend on buyers, the market, the Client's offer and delivery, and platforms Thurlow does not control. Thurlow promises the deliverables in section 3, on the dates in section 4, and the remedies in section 7.
10Ownership and use of the work
Once the fee is paid in full, the Client owns the priority build and the Blueprint and may use them in its own business. Third-party materials, such as fonts or images, stay under their own licences.
Thurlow keeps ownership of its methods, frameworks, templates and names, including the Four Buyer Barriers, the Obvious Choice Audit, the Obvious Choice Blueprint and the Obvious Choice Sprint. The Client may not resell, teach or republish them as its own. The Client keeps ownership of everything it provides to Thurlow.
11Confidentiality and client data
Each party will keep the other's non-public information confidential, use it only for the Sprint, and not share it with anyone else except advisers who are bound to keep it confidential, or as the law requires. This does not cover information that is public, or that the receiving party already had or learned from another source. This section applies for 3 years after the Sprint ends.
The Client's evidence may include recordings or messages from its own buyers. The Client confirms it has the right to share them. Thurlow will keep only what the Sprint needs and, on the Client's written request after the Sprint, will delete the Client's evidence materials, other than what the delivered Blueprint contains or the law requires Thurlow to keep.
12Case study permission
The Client chooses in the intake form whether Thurlow may describe the Sprint as an anonymized case study. Thurlow will not use the Client's name, logo or any detail that identifies the Client without separate written approval. The choice does not affect the fee, the deliverables or the refunds. If the Client makes no choice, Thurlow treats it as a refusal.
13Limit of liability
To the extent the law allows, Thurlow's total liability to the Client arising from the Sprint is limited to the fee the Client has paid. Neither party is liable to the other for lost profit, lost revenue or other indirect losses. This limit does not apply to fraud or wilful misconduct.
14Governing law and disputes
The laws of Ontario, and the federal laws of Canada that apply there, govern these Terms. The parties will first try to resolve a dispute through a conversation between Segun Makinde and the person who accepted these Terms for the Client. If that does not resolve it, the dispute will be heard in the courts of Toronto, Ontario.
15General terms
- Whole agreement. These Terms, with the Client's intake form confirmation, are the whole agreement between the parties about the Sprint and replace any earlier proposal, message or discussion. Any change must be in writing and agreed by both parties.
- Independent parties. Thurlow is an independent contractor. These Terms create no partnership, joint venture or employment.
- Assignment. Neither party may transfer these Terms without the other's written consent.
- Events outside control. Neither party is in breach for a delay caused by an event outside its reasonable control, such as illness, fire, flood, a power or internet outage, or a government order. Affected dates move by the length of the delay.
- Notices. Notices go by email to the address the Client used at checkout, and to hello@thurlowmarketing.com.
- Severability. If a provision is found unenforceable, the rest of these Terms still applies.
- Electronic acceptance. Acceptance at checkout and the intake form confirmation count as the Client's agreement in writing.
- Surviving terms. Sections 7, 9, 10, 11, 13 and 14 continue after the Sprint ends.
- Changes to these Terms. Thurlow may update these Terms for future Sprints. A Sprint is governed by the version the Client accepted.
Earlier version: 2026-10-13, which governs Sprints accepted before October 16, 2026.
